Chapter 6: The Hearing He Didn't Expect

The emergency custody hearing was set for a Thursday morning, eleven days after the party.

Alejandro arrived with two attorneys and his mother.

He wore a dark suit.

He looked composed.

He shook hands with the clerk.

He smiled at the right moments.

Elena arrived with Dr.

Vargas, her father, and a folder that was now forty-seven pages thick.

The hearing room was small.

A judge, a clerk, two tables.

The kind of room where large things happened quietly.

Alejandro's lead attorney, a man named Licenciado Fuentes, opened first.

"Your Honor, our client is seeking to establish primary residence for the minor child Nicolás pending the formal divorce proceedings.

We have concerns about the stability of the current living arrangement, given that Mrs.

Alcántara has recently relocated to her father's property and—"

"The child is eleven weeks old," Dr.

Vargas said.

The judge looked at her.

"Forgive the interruption, Your Honor.

But the child is eleven weeks old, exclusively breastfed, and currently in the care of his mother, who has not left the city, has not restricted the father's access, and has not done anything except leave a home where she was physically harmed." Dr.

Vargas placed a document on the table.

"The hospital report from that evening.

Documented injury to the left cheekbone consistent with blunt force impact."

Fuentes kept his expression neutral.

"Our client disputes the characterization of that incident."

"The recording does not dispute it," Dr.

Vargas said.

She placed a second document on the table.

"Audio file, timestamped, automatically backed up to two external contacts and a cloud server at the time of the incident.

The file includes the impact, the immediate aftermath, and subsequent statements made by multiple parties present."

Alejandro leaned toward Fuentes and said something Elena couldn't hear.

Fuentes cleared his throat.

"Your Honor, the admissibility of any such recording—"

"Will be determined in the appropriate proceeding," the judge said.

"Today we are here on the question of temporary custody.

Continue, Dr.

Vargas."

"Thank you, Your Honor.

We are not opposing visitation.

We are opposing any arrangement that removes an eleven-week-old nursing infant from his primary caregiver based on a filing made nine days after his mother left the marital home following a documented physical incident.

The timing of this filing is not coincidental.

It is strategic."

Fuentes stood.

"That is a serious characterization—"

"It is an accurate one," Dr.

Vargas said.

"Our client received a voicemail from Mr.

Alcántara four days ago in which he explicitly referenced her father's company in the context of the divorce proceedings.

We have submitted that voicemail as Exhibit C."

Alejandro's jaw tightened.

Just slightly.

Elena watched it.

The judge reviewed the exhibit log.

"I see it."

"We would also note," Dr.

Vargas continued, "that Mr.

Alcántara has a second child — a three-year-old boy named Mateo, born during the marriage — whose mother has not been contacted by Mr.

Alcántara's legal team regarding any custody or support arrangement.

We raise this not to complicate today's hearing, but to provide the court with a complete picture of the circumstances."

The silence that followed was the particular silence of a room in which something has shifted and everyone knows it.

Alejandro's mother, seated behind him, made a small sound.

Fuentes put a hand on Alejandro's arm.

The judge looked at Alejandro directly.

"Mr.

Alcántara.

Is the child Mateo your biological son?"

A pause.

"Yes," Alejandro said.

"And you have made no formal legal arrangement regarding his custody or support."

"That matter is — ongoing."

"I see." The judge made a note.

She looked at both tables.

"I am not going to remove an eleven-week-old infant from his mother's care on the basis of this filing.

Temporary primary residence remains with Mrs.

Alcántara.

Mr.

Alcántara will have supervised visitation, twice weekly, at a location agreed upon by both parties.

We will revisit at the sixty-day mark." She closed the folder.

"I would strongly suggest, Licenciado Fuentes, that your client use the next sixty days to formalize his obligations to both of his children rather than attempting to use one as leverage against the other."

She stood.

The clerk called the room to order.

Fuentes gathered his papers.

He leaned close to Alejandro and said something low and quick.

Alejandro looked across the room at Elena.

It was not the look of a man who had accepted defeat.

It was the look of a man recalculating.

"He'll try something else," Dr.

Vargas said quietly as they walked out.

"He's not done."

"I know," Elena said.

"Are you ready for that?"

Elena looked down the corridor toward the exit, where her father was waiting with Nicolás in his arms.

"He's been trying to control what I know since before we were married," she said.

"He didn't succeed then.

He won't succeed now."

Dr.

Vargas nodded.

She picked up her briefcase.

"Then let's go prepare for what comes next."

They walked out.
